Rights and responsibilities of users
RIGHTS
• Everyone has the right to health protection, notably to enjoy the best possible state of physical, mental and social health;
• The patient has the right to be treated with respect for human dignity, on an equal footing with others;
• The patient has the right to respect for their cultural, philosophical and religious beliefs;
• The patient has the right to freely choose health care services and providers, within the limits of available resources;
• The patient has the right to receive, promptly or within a clinically acceptable timeframe, as appropriate, the health care they need, in accordance with good practices of quality and safety in health;
• The patient has the right to receive the most appropriate and technically correct health care, which must be provided humanely and respectfully;
• Regarding patients with identical clinical conditions of severity and complexity, priority should be given to people with disabilities or incapacities equal to or greater than 60% (this does not apply to situations of in-person public service carried out through prior scheduling);
• The patient has the right to be informed about their health situation, possible treatment alternatives, and the likely evolution of their condition;
• The patient has the right to obtain a second opinion on their health situation;
• The patient has the right to free and informed decision-making regarding the provision of healthcare, which constitutes a manifestation of respect for them and for the realization of the values of human dignity, freedom, and personal self-determination;
• The patient has the right to confidentiality of all clinical information and identifying elements concerning them;
• The patient has the right to access their personal data and health information contained in their medical record;
• The patient has the right to privacy in the provision of any and all healthcare acts;
• The patient has the right, personally or through a representative, to present suggestions, complaints, and grievances regarding all aspects related to the provision of healthcare, and the right to obtain an adequate, clear, and understandable response.
DUTIES
• The patient has a duty to care for their health. This means they must strive for the most complete recovery possible and also participate in promoting their own health and the health of the community in which they live;
• The patient has a duty to provide healthcare professionals with all updated and necessary information to obtain a correct diagnosis and appropriate treatment;
• The patient has a duty to treat other patients, as well as the healthcare professionals with whom they interact, with courtesy and respect;
• The patient has a duty to cooperate with healthcare professionals in all aspects related to their situation;
• The patient has a duty to respect the rules of organization and operation of healthcare services and establishments;
• The patient has a duty to attend scheduled appointments on the date and time indicated;
• The patient has a duty to use healthcare services appropriately, to actively collaborate in reducing unnecessary expenses, and to pay any charges arising from the provision of healthcare, when applicable.
